COLFAX, Wash. (AP) – A mistrial has been declared in the case of a former Pullman police sergeant charged with sexual misconduct.

Whitman County Superior Court Judge Gary Libey declared the mistrial on Thursday evening because the jury could not reach a verdict after one day of deliberations.

Prosecutor Denis Tracy says he must decide whether former police sergeant Dan Hargraves will face another trial.

Hargraves was charged with custodial sexual misconduct after an 18-year-old Washington State University student alleged he sexually assaulted her while she was intoxicated and in his custody in March of 2018.

The Moscow-Pullman Daily News says Hargraves, a 19-year veteran with the Pullman Police Department, was arrested last October.

The Washington State Patrol found DNA evidence that matched Hargraves on the victim’s clothing. Hargraves denied the allegations.
